North Dakota attorney general says F5 Project concerns were substantiated; nonprofit signs compliance agreement

North Dakota Attorney General Drew Wrigley announced the resolution of a months-long consumer-protection investigation into F5 Project. According to Wrigley and local reporting, the investigation substantiated concerns about unauthorized or improperly structured loans to two executives and conflict-of-interest or self-dealing issues involving property owned by those executives and leased for nonprofit operations. F5 signed an Assurance of Voluntary Compliance requiring stronger board documentation, budget and compensation votes, and quarterly compliance reviews. The agreement reportedly does not require F5 to admit or deny the state’s allegations.

Donor relevance

Why this matters

The resolution changes the status of earlier questions about executive loans and related-party property transactions by adding a regulator’s announced findings and enforceable governance requirements. F5 has received substantial public funding and provides reentry, housing and employment support to people leaving incarceration.

Organization response

Board president Evan Francen said the matters arose from practices predating his board service and that he had seen no reason to believe there was malicious intent or a deliberate effort to misuse the nonprofit for personal gain. He acknowledged the need for stronger governance, controls and accountability and said F5 intends to continue operating and complying with the agreement.
